What is a FOST?
FOST is an acronym for ‘Finding of Suitability to Transfer.’

This policy provides guidance to the Department of Defense. Under the FOST process, documentation is required for parcels of real property that become available through the Base Realignment and Closure (BRAC) process and which are environmentally suitable for transfer by deed. (See Section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) (42 U.S.C. Section 9620(h)).
In addition to property that is undisturbed by past activities, this FOST guidance also applies to property where a release or disposal of hazardous substances or petroleum products has occurred and which is being considered for transfer by deed. Nothing in this policy negates the requirement to comply with EPA regulations. After transfer, the U.S. Government remains responsible in perpetuity for any remediation necessitated by contamination that resulted during its ownership.

In August, 2002, FOST 1 of the former South Weymouth Naval Air Station was signed. This included 478 acres. In January, 2003, an additional 71 acres were included under FOST 2. Both FOSTS were transferred to SSTTDC on May 15, 2003.

Of the FOST 1 and 2 total, 225 acres were transferred to the South Shore Tri-Town Development Corp., under a Public Benefit Conveyance (PBC), designated as public parkland in perpetuity through an agreement with the U. S. Dept. of the Interior, National Park Service. An additional 324 acres were transferred as an Economic Development Conveyance (EDC) approved for commercial use.

In the historic first transfer of former base land for private development, on June 23, 2006, SSTTDC transferred 324 acres (EDC property) to master developer LNR Property Corp.
